PLEASE READ THESE TERMS OF SERVICE ("TERMS") CAREFULLY BEFORE USING THE FIXMATE APPLICATION. BY ACCESSING OR USING THE APP, YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE THE APP.

1. Acceptance of Terms

These Terms of Service constitute a legally binding agreement between you ("User," "you," or "your") and FixMate ("Company," "we," "us," or "our") governing your access to and use of the FixMate mobile application (the "App") and all related services, features, and content.

By downloading, installing, or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy, which is incorporated herein by reference.

2. Eligibility

You must be at least 18 years old to use the App. By using the App, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms.

3. Description of Service

FixMate is an AI-powered home repair assistance application that provides:

  • AI-generated repair guidance and recommendations
  • Photo analysis for repair diagnostics
  • Connection to local contractors and service professionals
  • Project tracking and management tools

4. Important Disclaimers and Limitations

IMPORTANT: Please read this section carefully. It contains important limitations on our liability.

4.1 For Informational Purposes Only

THE ADVICE, RECOMMENDATIONS, AND INFORMATION PROVIDED THROUGH THE APP ARE FOR INFORMATIONAL AND EDUCATIONAL PURPOSES ONLY. FIXMATE IS NOT A SUBSTITUTE FOR PROFESSIONAL ADVICE FROM LICENSED CONTRACTORS, ENGINEERS, ELECTRICIANS, PLUMBERS, OR OTHER QUALIFIED PROFESSIONALS.

4.2 No Liability for Damages, Injury, or Death

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FIXMATE, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY DEATH, PERSONAL INJURY, PROPERTY DAMAGE, FIRE, FLOOD, STRUCTURAL DAMAGE, ELECTRICAL DAMAGE, PLUMBING DAMAGE, OR ANY OTHER HARM OR DAMAGES OF ANY KIND ARISING FROM OR RELATED TO:

  • Your use of or reliance on any advice, recommendations, or information provided through the App
  • Any repairs, modifications, or work you perform based on information from the App
  • Any decisions you make based on the App's guidance
  • Any contractor or service professional connected through the App

YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT YOU USE THE APP AND ANY INFORMATION PROVIDED ENTIRELY AT YOUR OWN RISK.

4.3 Always Consult Licensed Professionals

Before undertaking any home repair, renovation, or modification project, you should:

  • Consult with licensed contractors, engineers, or other qualified professionals
  • Obtain all required permits and approvals from local authorities
  • Ensure compliance with all applicable building codes, safety regulations, and laws
  • Have work inspected by appropriate authorities where required
  • Verify the credentials, licensing, and insurance of any contractor you hire

4.4 Permit and Code Compliance

Many home repair and renovation projects require permits and must comply with local building codes. IT IS YOUR SOLE RESPONSIBILITY to:

  • Determine whether permits are required for your project
  • Obtain all necessary permits before beginning work
  • Ensure all work complies with applicable building codes
  • Arrange for required inspections

FixMate does not provide permit services and is not responsible for permit compliance.

5. Contractor Connections

5.1 Independent Contractors

Contractors and service professionals accessible through the App are independent third parties, not employees or agents of FixMate. We do not employ, supervise, or control these contractors.

5.2 No Endorsement

The inclusion of any contractor in the App does not constitute an endorsement, recommendation, or guarantee of their services, quality of work, licensing status, or insurance coverage.

5.3 User Responsibility

When engaging any contractor, you are solely responsible for:

  • Verifying their credentials, licenses, and insurance
  • Negotiating terms, pricing, and scope of work
  • Ensuring they obtain required permits
  • Supervising and approving their work
  • Resolving any disputes directly with the contractor

5.4 Information Sharing

By requesting contractor connections, you consent to us sharing your information (including name, contact details, location, and project information) with contractors to facilitate your project.

6. Subscription and Payment

6.1 Subscription Plans

FixMate offers subscription plans with different features and pricing:

  • Yearly Plan: $99.00 per year
  • Monthly Plan: $14.99 per month
  • Free Trial: 7-day free trial, then $4.99 per week

6.2 Automatic Renewal

All subscriptions automatically renew at the end of each billing period unless cancelled. You may cancel your subscription at any time through your Apple ID account settings.

6.3 Refunds

Refunds are handled according to Apple's App Store refund policies. We do not directly process refunds.

6.4 Price Changes

We reserve the right to change subscription prices. Price changes will be communicated in advance and will take effect at the start of your next billing period.

7. Service Suspension and Termination

7.1 Our Right to Suspend or Terminate

WE RESERVE THE RIGHT TO SUSPEND, RESTRICT, OR TERMINATE YOUR ACCESS TO THE APP AT ANY TIME, FOR ANY REASON OR NO REASON, WITH OR WITHOUT NOTICE, INCLUDING BUT NOT LIMITED TO:

  • Violation of these Terms
  • Abusive, fraudulent, or illegal activity
  • Non-payment of subscription fees
  • Extended periods of inactivity
  • Technical or security reasons
  • Business reasons, including discontinuation of the App

7.2 Effect of Termination

Upon termination:

  • Your right to use the App immediately ceases
  • We may delete your account and associated data
  • Provisions that should survive termination will remain in effect

8. Intellectual Property

8.1 Ownership

The App, including all content, features, and functionality, is owned by FixMate and is protected by copyright, trademark, and other intellectual property laws.

8.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.

8.3 Restrictions

You may not:

  • Copy, modify, or distribute the App or its content
  • Reverse engineer, decompile, or disassemble the App
  • Remove any copyright or proprietary notices
  • Use the App for any commercial purpose without our consent

9. User Content

9.1 Your Content

You retain ownership of photos, messages, and other content you submit through the App ("User Content"). By submitting User Content, you grant us a worldwide, royalty-free license to use, store, and process it for providing our services.

9.2 Content Restrictions

You agree not to submit content that:

  • Is illegal, harmful, or offensive
  • Infringes on others' rights
  • Contains malware or harmful code
  • Violates these Terms

10. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
  • ACCURACY OR RELIABILITY OF AI-GENERATED ADVICE
  • UNINTERRUPTED OR ERROR-FREE SERVICE

WE DO NOT WARRANT THAT THE ADVICE PROVIDED WILL BE ACCURATE, COMPLETE, SAFE, OR SUITABLE FOR YOUR SPECIFIC SITUATION.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL FIXMATE, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Any loss of profits, revenue, data, or use
  • Any personal injury, death, or property damage
  • Any damages exceeding the amount you paid us in the twelve (12) months preceding the claim

Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.

12. Indemnification

You agree to indemnify, defend, and hold harmless FixMate and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from:

  • Your use of the App
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Any work performed based on App recommendations

13. Dispute Resolution

13.1 Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.

13.2 Arbitration

Any dispute arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

13.3 Class Action Waiver

You agree to resolve disputes on an individual basis and waive any right to participate in class actions.

14. General Provisions

14.1 Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and FixMate.

14.2 Severability

If any provision is found unenforceable, the remaining provisions will continue in effect.

14.3 Waiver

Our failure to enforce any provision does not constitute a waiver of that provision.

14.4 Assignment

You may not assign these Terms without our consent. We may assign these Terms at any time.

14.5 Modifications

We reserve the right to modify these Terms at any time. Changes will be effective upon posting in the App. Your continued use constitutes acceptance of modified Terms.
